What is a board certified criminal defense attorney?

A board certified criminal defense attorney has passed a specialty exam, peer review and trial-experience checks run by a certifying body such as the National Board of Trial Advocacy or a state bar board. Certification is voluntary and expires: NBTA certificates last 5 years.

The National Board of Trial Advocacy (NBTA) describes itself as a national board certifying organization accredited by the American Bar Association. Its standards for Criminal Trial Law certification, revised in May 2024, set the experience, education and peer-review minimums listed below.

The North Carolina State Bar runs a parallel state program for state criminal law, juvenile delinquency law and federal criminal law. Its state criminal law standard asks for an average of 500 practice hours a year over the 5 years before applying, 40 hours of criminal law CLE in the prior 3 years and a written exam. NBTA accepts the criminal trial written exams of Florida, New Jersey and Texas as equivalents of its own exam, and it tells Florida Bar members to hold the Florida Bar's criminal trial certification before applying.

How many federal criminal defendants need defense counsel each year?

US district courts took in 82,055 criminal defendants, transfers included, in the 12 months ending June 30, 2026, 6.1% more than in the previous 12 months. Another 109,474 defendants were pending when the period closed, each one an open defense file.

The Administrative Office of the US Courts breaks new federal defendants down by offense. Immigration offenses, led by improper reentry with 29,564 defendants, outnumber the drug, firearms and fraud defendants combined.

Immigration offenses accounted for 34,919 of 81,946 new federal criminal defendants, 42.6% of the total and more than twice the 14,722 drug-offense defendants.

How much criminal defense work is publicly funded?

Federal defenders receive about 60% of Criminal Justice Act appointments, and private panel attorneys take the other 40%, according to the US Courts. Panel attorneys earn $177 an hour in non-capital cases for work performed on or after January 1, 2026.

The Bureau of Justice Statistics measured how often felony defendants had publicly financed counsel in a report released November 29, 2000. Publicly financed counsel, meaning public defenders, attorneys assigned from lists and groups under contract, represented about 66% of federal felony defendants in 1998 and 82% of felony defendants in the 75 most populous counties in 1996.

Public funding does not remove private firms from the market. The US Courts describe Criminal Justice Act panel attorneys as private attorneys who accept CJA assignments and use court funds to hire investigators, interpreters and other necessary experts, and approximately 13,000 of them take assignments each year. The same office counts 83 federal defender organizations serving 92 of the 94 federal judicial districts.
