What state bar information do trademark filings require?
A US attorney recognized in a trademark case provides the state of bar admission, the date of admission and the bar license number where that state issues one, under 37 CFR 2.17(b)(3). The USPTO keeps this bar information out of public trademark records.
The requirement dates from the USPTO rule effective August 3, 2019, the same rule that made foreign-domiciled applicants hire US counsel. Attorneys attest to active membership in good standing of the bar of a state's highest court, and the Office can require evidence of it. Bar details typed into the Trademark Electronic Application System (TEAS) do not display on the status tab of the Trademark Status and Document Retrieval system.
Trademark practice has no USPTO exam. Rule 37 CFR 11.14(a) states that an attorney is not required to apply for registration or recognition for trademark matters, and a patent registration alone does not authorize trademark work. State bar admission is the credential for this segment. Rule 2.17(b)(3) asks for a bar license number only where the named state issues one, a difference the section on state bar numbers in lawyer email records explains.
