Registered patent attorney vs patent agent: what is the difference?

A registered patent attorney is a lawyer admitted to a state bar who also holds USPTO registration; a patent agent holds the same USPTO registration without being an attorney. The USPTO roster listed 38,406 patent attorneys and 14,725 patent agents on September 16, 2026.

The USPTO Office of Enrollment and Discipline, OED, gives the registration exam, often called the patent bar: 100 multiple-choice questions in two 3-hour sessions, with 63 of 90 scored questions needed to pass. Rule 37 CFR 11.6(a) registers attorneys as patent attorneys and 11.6(b) registers non-attorneys as patent agents, and an attorney files a certificate of good standing no more than 6 months old to receive the attorney registration.

The USPTO states that patent agents cannot argue patent cases in courts or perform services their local jurisdiction treats as practicing law. This file covers US attorneys, and it reports each one's bar number and bar admission state.
