What is the federal estate tax exemption for 2026?

$15,000,000 per decedent. The IRS set the 2026 basic exclusion amount at $15,000,000 after Public Law 119-21, signed July 4, 2025, amended section 2010(c)(3) of the Internal Revenue Code. The amount for 2025 deaths was $13,990,000, and the annual gift exclusion stays at $19,000 for 2026.

The exclusion also sets the filing line. According to the IRS, an estate files Form 706 for a 2026 death when the gross estate, plus adjusted taxable gifts and specific gift tax exemption, exceeds $15,000,000. Executors use Form 706 to figure the federal estate tax and the generation-skipping transfer tax on direct skips. The IRS confirmed the 2026 figures in Revenue Procedure 2025-32, announced October 9, 2025.

What is an Estate Planning Law Specialist (EPLS)?

An Estate Planning Law Specialist is an attorney board certified in estate planning by the Estate Law Specialist Board, an ABA-accredited subsidiary of the National Association of Estate Planners & Councils (NAEPC). Candidates show 5 years of practice with at least 40% of their time in estate planning, pass an exam and clear peer review.

NAEPC describes EPLS as the only national board certification of estate planning attorneys, next to state bar programs that serve lawyers in their own states. According to NAEPC, the American Bar Association first accredited the program in 1996 and most recently reaccredited it on February 3, 2025.

The 40% practice share counts estate planning, estate administration, tax and litigation work over the 5 years before applying. Applicants complete 36 hours of estate planning CLE before filing and 15 hours each year once certified. They list 8 colleagues from outside their firm, most of whom have known them for at least 3 years. The exam has 80 multiple-choice questions, taken online or on paper under a licensed attorney proctor from another firm. The application fee is $600, or $500 for members of an NAEPC-affiliated estate planning council.

An EPLS certification lasts 5 years. Renewal repeats the practice, peer review, education and good-standing checks without a second exam, and disbarment or suspension in any jurisdiction revokes the certificate. NAEPC makes each specialist responsible for following state rules on how the title is communicated.

The American College of Trust and Estate Counsel (ACTEC), founded in 1949, is an organization of trust and estate lawyers and law professors whose Fellows are elected by their peers. ACTEC membership is a fellowship, so it sits apart from the board certifications in the table.

EPLS is the national certification route, North Carolina and Louisiana certify estate lawyers through their state programs, and ACTEC recognizes lawyers by peer election instead of an exam.
