How do disability lawyers register with SSA?

Disability lawyers register on Form SSA-1699, which issues a Representative Identification number (Rep ID), before SSA accepts an appointment on any claim. The claimant and the lawyer then sign Form SSA-1696, and a firm that receives assigned fees registers on Form SSA-1694.

SSA's final rule of August 21, 2024 made registration mandatory for representatives on September 30, 2024 and opened direct fee payment to firms on December 9, 2024. The Rep ID stands in for the representative's Social Security number in dealings with SSA. Under 20 CFR 404.1705, an attorney qualifies through the right to practice before a state or federal court, with no SSA suspension or disqualification.

SSA approves fee agreements up to the lesser of 25% of past-due benefits or $9,200, the cap for favorable decisions issued on or after November 30, 2024, which a May 6, 2025 Federal Register notice kept in place. On each direct payment, SSA keeps an assessment of 6.3% for 2026, limited to $123.

Non-attorneys represent claimants too. Under 42 U.S.C. 406(e), a non-attorney receives direct fee payment only with a bachelor's degree or equivalent qualifications, a passed SSA examination, professional liability insurance, a criminal background check and ongoing continuing education. The North Carolina State Bar certifies Social Security disability law as a specialty, requiring an average of 600 practice hours a year over 5 years and a 6-hour exam.

Immigration courts use a parallel agency model: 8 CFR 1292.1 requires attorneys to register with the Executive Office for Immigration Review and also recognizes accredited representatives.
